SC seeks documents regarding Parajuli’s appointment to CJ post
The Supreme Court has ordered to present the documents of work proceedings conducted by three constitutional bodies regarding the recommendation and appointment of Gopal Prasad Parajuli to the post of Chief Justice.
A single bench of SC Justice Kedar Prasad Chalise, on Friday, issued an order to that effect while hearing on a writ petition registered at the apex court on Wednesday, challenging the legality of the oath taken by President Bidhya Devi Bhandari from former chief justice Gopal Prasad Parajuli.
The apex court, through its order, has sought the Judicial Council’s (JC) decision regarding recommendation of Parajuli to the post of Chief Justice and also the JC’s decision regarding the former CJ’s age.
Likewise, the SC has also sought the decision taken by Constitutional Council while appointing Parajuli to the post of Chief Justice.
Similarly, the top court in its order has sought, “Explanation from the President’s Office regarding the action course and correspondence on the resignation submitted by Parajuli as the Chief Justice on March 15 to the President.”
The writ petition was registered, on March 28, by advocates Hem Mani Subedi and Narayan Kharel arguing that it is unconstitutional for President Bhandari to take oath from CJ Parajuli whose tenure had expired on August 5 last year according to the letter issued by the JC.
