Dr KC refuses hearing; vows to fight ‘corrupt chief justice’

Feb 21, 2018-Dr Govinda KC on Tuesday denied accepting the scheduled hearing on his case relating to contempt of court.

Stating Chief Justice Gopal Parajuli has a vested interest in the hearing and, because there is a conflict-of-interest, he cannot accept the date of hearing, said Dr KC.

“CJ Parajuli is trying to impose the hearing day within next 10 days which we cannot accept,” said Dr KC. The senior orthopaedic surgeon of Tribhuvan University Teaching Hospital has said that deeds of CJ Parajuli including the intimidation and threatening his advocate is also unacceptable and completely violates the rule of law.

“Until and unless he [CJ Parajuli] is in Supreme Court, we cannot expect justice. My fight is against the corrupt CJ and not against the judicial system,” said Dr KC. “I’ll not follow its instructions on the case relating to contempt of court until CJ Parajuli steps down and there is a way for a fair investigation into his citizenship and other documents.”

The citizenship row of CJ Parajuli surfaced after the SC, on January 7 this year, decided to reinstate Dr Shashi Sharma as the Dean of Institute of Medicine. Dr KC immediately began his 14th fast-unto-death stating that the court’s decision to reinstate Dr Sharma was a “systematic effort to affiliate new colleges and imperil medical education in the country”. He had begun the fast demanding resignation and action against CJ Parajuli. However, that same night Dr KC was arrested on contempt of court charges leading to his hearing at the court.

Dr KC was freed on January 9 and on January 10 the apex court decided to probe the authenticity of CJ Parajuli’s citizenship and educational certificates. Then, Dr KC has been ordered to appear before the court for hearing on February 20.

However, Dr KC on Tuesday clarified his case against another contempt of court case filed by the owner of National Medical College, Jainudin Ansari. In this case, Dr KC has reiterated that CJ Parajuli’s decision in various capacities in judiciary has impacted the medical education. He has said that all the decisions have favoured medical mafia.

“Speaking against justice who has given wrong decisions and has acted wrongly is not a case of contempt-of-court,” reads the statement recorded by Dr KC. In his written statement to the court, Dr KC has also alleged CJ Parajuli of teaming up with “medical mafia”. He has said that CJ Parajuli misused his Facebook account where he has shared an interview of businessman Durga Prasain, who deems Dr KC as “mafia” and advocates “finishing off” the crusader and his team members.

Protesters arrested

Police arrested around a dozen protesters demanding investigation into the citizenship of Chief Justice Gopal Prasad Parajuli from Kathmandu District Administration Office.

The protesters had reached the DAO office on Tuesday in support of Dr Govinda KC who had gone to the office to file an application for investigation into the matter.

Doctors, students and Bibeksheel Sajha’s Kathmandu Metropolitan City mayoral candidate Ranju Darshana are among the arrestees.

Following the contempt of court case against Dr Govinda KC, the Supreme Court (SC) directed to investigate the authenticity of citizenship document and education certificates of Chief Justice Parajuli. Dr KC has charged CJ Parajuli of using forged academic documents, maintaining two citizenship certificates from two places and reducing his age to hold the top Judiciary post, among others.
