SC sentences Manange to 5 years in prison

Jan 16, 2018-The Supreme Court (SC) has sentenced provincial member Deepak Manange aka Rajib Gurung to five years in prison on murder charge.  He was elected from Manange Province Kha. A joint bench of Justices Deepak Raj Joshi and Purushottam Bhandari on Tuesday upheld the verdict of then Patan Appellate Court.

Manange had filed his candidacy in the provincial assembly election as an independent candidate. A flashback to Manange’s criminal record Thirteen years ago, Manange’s gang had attacked Milan Chakre’s gang with Khukuri. Police had filed a murder case against Manange and his accomplices. The Kathmandu District Court decision ruled out the murder charge and sentenced some of Manange’s accomplices to two years in prison on assault charge. Manange’s accomplices involved in the crime were Rewat Karki, Ramesh Sunuwar, Ganesh Lama and Umesh Lama, among 12 others.

Dissatisfied by the district court’s verdict, some government lawyers knocked on the door of Patan Appellate Court seeking punishment against the accused. In 2012, the Patan Appellate Court ruled that it was a murder case and awarded five years jail sentence to Manange. The Appellate Court, however, acquitted Manange’s four accomplices of the charge. The office of the Attorney General moved the Supreme Court seeking punishment to four of Manange’s accomplices. The Supreme Court in its hearing on Tuesday, on the review case lodged in May 2013, upheld the Patan Appellate Court’s decision. “Deepak Manange remained quite instead of asking SC to dismiss the verdict of Patan Appellate Court,” Attorney General Office’s spokesperson Sanjiv Regmi told the Post. “The SC has today upheld the decision of the Appellate Court in the review case lodged by government lawyers that sought punishment to Manange’s other accomplices too,” he said. It means that Manange will have to remain behind bars while his four accomplices have been set free.

According to a source at Supreme Court, the individual convicted in a criminal case cannot become a parliamentarian. “Manange cannot become the parliamentarian as the Supreme Court decision will be implemented immediately,” said the source, adding that Manange has already served two years in prison as per the Kathmandu District Court’s decision.
